According to a lawsuit obtained by TMZ on November 22, 2015, the Oscar-winning actor is accused of assaulting a woman at Catch NYC & Roof in August 2015.

The unnamed plaintiff claims that she was at the New York City restaurant when she noticed Foxx nearby.

Around 1 a.m., her friend asked Foxx for a photo. He allegedly responded with remarks like “Sure, baby, anything for you” and comments about her appearance and scent.

The lawsuit alleges that Foxx later took the woman to another area of the rooftop. He is accused of sexually assaulting her by reaching under her top, rubbing her breasts, and touching her genitals.

The assault reportedly stopped when her friend intervened. The woman claims to have suffered both physical injuries and emotional distress, requiring medical treatment.

Despite the serious nature of the allegations, Foxx has not publicly addressed them. E! News reached out to Foxx’s representative for comment on the lawsuit, but as of now, there has been no response.

Earlier this year, the actor made headlines for a health scare that led to his hospitalization in April. Foxx took to Instagram in July to express gratitude for the support he received during that challenging time, assuring fans that he was on the road to recovery.

While addressing concerns about his health, Foxx emphasized his desire for people to see him in good spirits and enjoying life. He dismissed rumors of paralysis or blindness but acknowledged that the experience had been tough.
